Police say that at the time of the accident a 15-year-old female was ejected from the vehicle, suffering from serious injuries. Another child, a male, was uninjured in the crash. Police say that the driver, Timothy Karl Gatto, 50, was found to be intoxicated and after failing field sobriety testing, he was arrested. He refused to submit a chemical test to determine his BAC. Gatto has been charged with vehicular assault in the second degree, DWI, two counts of endangering the welfare of a child, and failure to keep right.
