Police say that the driver, Timothy Karl Gatto, 50, was found to be intoxicated and after failing field sobriety testing, he was arrested. He refused to submit a chemical test to determine his BAC. Gatto has been charged with vehicular assault in the second degree, DWI, two counts of endangering the welfare of a child, and failure to keep right.
